NEW PUBLICATION OF THE EUROPEAN CENTRE FOR MINORITY ISSUES (ECMI)
The European Centre for Minority Issues (ECMI) in Flensburg, Germany,
is pleased to announce the publication of ECMI Report #3 "Implementing
the Framework Convention for the Protection of National Minorities" by
Maria Amor Martin Estebanez and Kinga Gal.
On 10 November 1994, after several years of protracted discussions,
the Committee of Ministers of the Council of Europe adopted the
Framework Convention for the Protection of National Minorities. Due to
a multitude of compromises between diverging views of the member
states of the Council of Europe, the Convention is not wholly
satisfactory. Each government which intends to slip through it will no
doubt succeed. It is at the same time, however, exactly this high
degree of vagueness in the Convention's wording which leaves room for
interpretation in a more positive direction.
The Framework Convention entered into force on 1 February 1998, after
having been ratified by 12 member states. Immediately afterwards, the
procedure to nominate members for an Advisory Committee tasked to
monitor the implementation of the Convention was initiated. In order
to facilitate the difficult work of this newly-emerging monitoring
mechanism, the Danish-German European Centre for Minority Issues
(ECMI) held the international conference "Implementing the Framework
Convention for the Protection of National Minorities" in Flensburg,
Germany, from 12 to 14 June 1998. This conference brought together
members of the Advisory Committee, officials of the Council of Europe,
representatives of NGOs, international experts, and above all,
experienced practitioners from monitoring mechanisms of other
international conventions and treaties.
This detailed report reflects the presentations and discussions during
that conference, including suggestions for appropriate monitoring as
well as the ECMI Recommendations on the implementation of the
Framework Convention formulated with the active help of the
participants of the conference.
This report also contains a practical documentary appendix containing
the text of the Framework Convention, Resolution (97) 10 "Rules
adopted by the Committee of Ministers on the monitoring arrangements
under Articles 24 to 26 of the Framework Convention", the Outline for
Reports to be submitted pursuant to Article 25 paragraph 1 of the
Framework Convention (adopted on 30 September 1998), as well as the
Rules of Procedure of the Advisory Committee on the Framework
Convention (adopted on 29 October 1998).
ECMI hopes that this report will interest not only the international
expert community, but also those who will be directly involved in
monitoring and implementing the Framework Convention, whether on
behalf of States or NGOs.
