Amendments to the Estonian Law on citizenship

 
At the moment, there is a second hearing of the amendments the Law on
Citizenship. Arisen discussion on amendments to the Law on Citizenship
proposed by the Constitutional Commission of the Parliament (chairman
- Mr. Tiit Kabin) is issued in the following situation. Here we
enclose the free translation of the draft amendments to the Law on
Citizenship. MINELRES readers have a possibility to compare
aforementioned legal act with provisions of the UN Convention on the
Rights of the Child (1989).
 
Law on amendments to the Law on Citizenship and the Income Tax Law
(Draft 747 SE II-1) /Second hearing in the Parliament of Estonian
Republic/
 
1. The Law on Citizenship is amended by the Section 3.1 in the
following edition:
 
"Section 3.1
Conditions for receiving Estonian citizenship on the basis of
declaration
 
15.1 Reception of Estonian Citizenship on the basis of declaration
(1) A person, reaching 15 years of age, shall receive Estonian
citizenship on the basis of declaration, if:
1) he/she was born in Estonia after 25 December 1991;
2) his/her parents or single parent have permanently and lawfully
resided in Estonia at the moment of child's birth;
3) his/her parent was not a citizen of any country at the moment of
child's birth;
4) he/she did not obtain another citizenship;
5) he/she has received secondary or higher education in Estonian
language or has passed final examination on Estonian language in
secondary school with another teaching language or state examination
on Estonian language in gymnasium;
6) he/she has permanently and lawfully resided in Estonia for last 7
years;
7) he/she has not others legal grounds to apply for Estonian
citizenship;
8) he/she present appropriate application within 3 years after
attaining the age of fifteen years.
 
(2). A person who is named in Part 1 of the given Article shall
receive Estonian citizenship with exempt from the requirements
established in items 2-5, Article 6 of the present Law.
