The Election Law On City and Town Councils, District Councils and Pagasts*
Councils
Adopted on 13.01.1994

Article 9. The following persons shall not be nominated as candidates for the council election and shall not be elected to the councils:
1) persons, who are fulfilling court sentences in penitentiaries;
2) persons, who are recognized as incapacitated in accordance with the procedure set by law;
3) persons, who have been sentenced previously for intentional, severe crimes and whose sentences have not been expunged or annulled, except those pardoned;

5) persons, who after 13 January 1991 acted in the Communist Party of Soviet Union (Latvian Communist Party), International Front of Working People of the Latvian SSR, United Council of Working Collectives, Organisation of War and Labor Veterans, All-Latvian National Salvation Front, or regional committees of the abovementioned organisations;
6) persons, who are or have been salaried or contracted employees of the former USSR, Latvian SSR or foreign states� security, intelligence or counterintelligence services;
7) persons who are not proficient in the State language in accordance with the highest (third) knowledge level of the State language.

Article 17. The following documents shall be attached to the candidate list:

a) name, surname, year of birth, sex, and ethnicity of the candidate

If a person who has not graduated from a school with instruction in the Latvian language is proposed as a candidate, then a copy of the certificate of the highest (third) knowledge level of the State language shall be attached to the candidate list.

Registered candidate lists cannot be recalled by their petitioners, and changes can only be made to these lists by the Commission, which has registered this list, by one of the following ways:
1) striking the proposed candidate from the list, if:

b) restrictions mentioned in Article 9 of this Law are applicable to the candidate,

In the cases envisaged by subparagraphs "a", "b" and "e" of paragraph 1 of this article, the Commission shall strike off the candidate on the basis of document issued by the corresponding institution or of court verdict. That the candidate:

8) is not proficient in the State language in accordance with the highest (third) knowledge level of the State language, - is certified by document issued by the State Language Center

This Law takes effect at the moment of its proclamation.
This Law has been adopted in the Saeima on January 13, 1994.
