CONSTITUTIONAL LAW
ON AMENDMENTS TO THE CONSTITUTIONAL LAW ON HUMAN RIGHTS AND
FREEDOMS
AND THE RIGHTS OF ETHNIC AND NATIONAL COMMUNITIES OR MINORITIES
IN THE REPUBLIC OF CROATIA

Article l.
In the Constitutional Law on Human Rights and Freedoms and the Rights of Ethnic and National Communities or Minorities in the Republic of Croatia (Official Gazette Nos. 65/91, 27/92 and 34/92 -revised text, and No.68/95, Article 1, after para. 6 the following subpara. shall be added:
“- the Council of Europe Framework Convention on the Protection of National Minorities”
Article 2.
Article 3 shall be amended to read as follows:
"The Republic of Croatia shall protect the equality of the members of the national minorities: Albanians, Austrians, Bosniaks, Bulgarians, Czechs, Hungarians, Germans, Italians, Macedonians, Montenegrins, Poles, Romanies, Romanians, Russians, Ruthenians, Slovaks, Slovenians, Serbs, Turks, Ukrainians, Vlachs, Jews and other ethnic and national communities or minorities and encourage their universal development".
Article 3
Article 13 shall be deleted.
Article 4
In Article 15, para. 1, the words "In towns and other populated areas outside the special-status districts (Article 21)" shall be replaced by the words "In local self-government and administration units".
In paras. 3 and 4, the words "In towns and other populated areas outside the territories of special-status districts" shall be replaced by the words "In local self-government and administration units".
Article 5
In Article 18, para. 1, the word "Parliament" shall be replaced by the words "Croatian National Parliament".
Para. 2 shall be amended to read as follows:
"Members of ethnic and national communities or minorities whose share in the population of the Republic of Croatia is below 8% shall be entitled to elect at least five and maximum seven representatives to the House of Representatives of the Croatian National Parliament, under the Law on the Election of Representatives to the Croatian National Parliament".
Article 6
In Article 20, para. 2, the words "or districts" shall be deleted.
Article 7
Chapter V comprising Articles 21 through 51 shall be deleted.
Article 8
Chapter VI comprising Articles 52 through 57 shall be deleted.
Article 9
Article 58 shall be deleted.
Article 10
Chapter VIII comprising Articles 60 and 61 shall be deleted.
Article 11
The title of Chapter X, preceding Article 63: "X Final provisions" shall be amended to read as follows:
"X. TRANSITIONAL AND FINAL PROVISIONS".
Article 12
The provision of Article 18, para. 1, the part of the provision in para. 4 relating to the procedure of electing and recalling the Members of Parliament under para. 1, and the provision in para. 5 shall apply once the results of the next census in the Republic of Croatia have been made public.
Article 13
Nothing contained in this Constitutional Law shall be construed as implying any right to perform any activity or take any action in contravention of the fundamental principles of international law, especially in respect of sovereign equality, territorial integrity and political independence of States.
Article 14
The terminology used in this Constitutional Law on Human Rights and Freedoms and the Rights of Ethnic and National Communities or Minorities in the Republic of Croatia shall be adjusted to the current terminology used by international organizations and in international treaties.
Article 15
With the entry into force of this Constitutional Law, the Constitutional Law on the Suspension of Certain Provisions of tile Constitutional Law on Human Rights and Freedoms and the Rights of Ethnic and National Communities or Minorities in the Republic of Croatia (Official Gazette No.68/95) shall cease to apply.
Article 16
With the entry into force of this Constitutional Law the provision of Article 68, para. 4 of the Local Self-Government & Administration Law (Official Gazette Nos. 90/92, 94/93 117/93, 5/97 and l28/99) shall become null and void.
Article 17
The Legislation Committee of the House of Representatives of the Croatian National Parliament is authorized to prepare and issue a revised text of the Constitutional Law on Human Rights and Freedoms and the Rights of Ethnic and National Communities or Minorities in the Republic of Croatia.
Article 18
This Constitutional Law shall enter into force on the date of its promulgation by the House of Representatives of the Croatian National Parliament.
