LAW

ON CROATIAN RADIO AND TELEVISION

8 February 2001

I. GENERAL PROVISIONS

Article 1.

(1) Croatian Radio and Television is a legal person with a status of public institution whose organization and way of work are regulated under this Law and regulations brought on its’ basis.

(2) Founder of the public institution of Croatian Radio and Television is the Republic of Croatia.

II. PROGRAM COMMITMENTS AND OBLIGATIONS

Article 5.

(1) Programs of Croatian Radio and Television have to fulfill interests of public on both national and local levels, and should take care on an equal share of informative, cultural, educational and entertaining topics.

(2) While accomplishing program commitments, Croatian Broadcasting shall in particular:

- produce and/or broadcast shows programs intended to inform members of Croatian nation abroad,

- produce and/or broadcast shows programs intended to inform members of national minorities in the Republic of Croatia,

......................

(3) Government of the Republic of Croatia and Croatian Radio and Television shall regulate by agreement the mutual rights and obligations in relation to the paragraph 2 subparagraph 4 and 5 of this article.

Article 7.

Croatian Radio and Television is obliged to:

......................

- respect and support pluralism of political, religious, worldview and other ideas, and allow public to be acquainted with those ideas; Croatian Radio and Television should not promote viewpoints or interests of particular political party, or any other particular political, religious, worldview and similar position or interests.

Article 8.

It is forbidden in programs of Croatian Radio and Television:

- to support and spread national, racial or religious hatred, anti-Semitism and xenophobia, as well as support and spread of discrimination or animosity toward individuals and groups, on the basis of their origin, skin color, political belief, worldview, health condition, gender, sexual adherences or other characteristics,

Article 9.

(4) Usage of Croatian language is not obligatory in shows designated to informing of members of national minorities and ethnic communities.

V. GOVERNING AND MANAGING

Article 15.

Bodies of Croatian Radio and Television are:

a) Council of Croatian Radio and Television,

b) Managing Council of Croatian Radio and Television,

c) Principle of Croatian Radio and Television.

Article 16.

(1) Council of Croatian Radio and Television represents and protects interests of TV and radio audience in program production and surveillance.

(2) Council of Croatian Radio and Television has 25 members.

Article 17.

(1) One member for the Council of Croatian Radio and Television shall be assigned by each:

- Croatian Academy of Science and Arts,

- University community,

- Croatian Matica,

- Matica of Croatian emigrants,

- Croatian Society of Writers,

- Croatian Journalist Society,

- Croatian Olympic Committee,

- National minorities in the Republic of Croatia,

- Catholic Church in the Republic of Croatia,

- other religious communities in the Republic of Croatia,

- Trade Unions,

- Employers’ Unions,

- professional Film Unions,

- professional Drama Unions,

- professional Art Unions,

- professional Music Unions,

- Unions of Homeland War,

- Pensioners’ Unions,

- Civil and ecological initiatives,

- Consumer societies,

- Youth’s societies,

- Peasants’ societies.

(2) Associations mentioned in the paragraph 1 of this article shall name its’ representatives to the Council of Croatian Radio and Television in accordance to the law and their statutes for the election of members of governing bodies.

(3) Minister of culture, in accordance with previously acquired opinion of the Minister of justice, administration and local administration, shall decide on procedure, election and appointment of representatives to Council of Croatian Radio and Television that are nominated by two or more associations.

X. TRANSITIONAL AND FINAL REGULATIONS

Article 53.

Regional radio stations and regional TV centers are public media of Croatian Radio and Television with a special task to promote regional programs and programs in languages of national minorities in that area.

Article 56.

On the day when this Law will be put in force, previous Law on Croatian Radio and Television will be no longer valid ("Narodne novine", No 28/90., 35/91., 33/92., 43/92. - revised text, 94/93., 24/96. and 145/98.).

Article 57.

The implementation of this Law begins on the eighth day of its publication in "Narodne novine".
